Terms of Service

1. Purpose and Scope

These terms of service (hereinafter "ToS") govern the use of the CyberDash platform, a cybersecurity service developed and operated by ACKTECK, a simplified joint-stock company with capital of [AMOUNT], registered in the RCS of [CITY] under number [NUMBER], whose registered office is located at [ADDRESS].

The use of the CyberDash service implies full and complete acceptance of these ToS by the user. These ToS are accessible at any time on the platform and may be modified by ACKTECK. In case of modification of the ToS, the user will be informed by email with a 30-day notice period. Continued use of the Service after this period constitutes acceptance of the new ToS.

2. Definitions

For the purposes of these ToS:

• "Service": refers to the CyberDash platform and all associated services
• "User": refers to any natural or legal person using the Service
• "Account": refers to the User's personal space on the platform
• "Data": refers to all information transmitted by the User
• "Assets": refers to scanned elements (domains, IPs, emails)

3. Service Access

3.1 Registration

Access to the Service requires creating an Account. The User agrees to provide accurate, complete and up-to-date information during registration and to keep it updated.

3.2 Credentials

The User is responsible for the confidentiality of their login credentials. They agree to immediately inform ACKTECK of any unauthorized use of their Account.

3.3 Technical Requirements

The User must have Internet access and a compatible web browser. Connection and equipment costs remain the User's responsibility.

4. Service Description

CyberDash offers the following services:

• Vulnerability scanner for domains, IP addresses and emails
• Cybersecurity dashboard with metrics and alerts
• Specialized cybersecurity AI assistant
• Security audit services (depending on subscription)
• Shared-time CISO support (depending on subscription)
• Cybersecurity documentation and guides

Available features depend on the type of subscription taken by the User. ACKTECK reserves the right to evolve the Service and its features.

5. User Obligations

The User agrees to:

• Use the Service in compliance with applicable laws and regulations
• Not use the Service for illegal or malicious purposes
• Scan ONLY assets they own or for which they have explicit written authorization from the owner. Any violation of this obligation exposes the User to immediate account termination and possible legal action
• Respect the usage limits of their subscription
• Not attempt to bypass the Service's security measures
• Not resell or transfer Service access without authorization
• Immediately report any malfunction or security flaw

6. Pricing and Payment

6.1 Pricing

Service prices are indicated on the platform and may be modified by ACKTECK. The User will be informed by email of any price change with a minimum 15-day notice period. The User then has the option to cancel their subscription before the new prices take effect.

6.2 Payment Terms

Payment is made by credit card via our secure payment provider Stripe. Subscriptions are charged monthly and automatically renewed.

6.3 Payment Default

In case of payment default, Service access may be suspended after unsuccessful notice period of 15 days.

7. Intellectual Property

All Service elements (software, databases, content, trademarks, logos) are protected by intellectual property law and belong to ACKTECK or its partners.

The User has a personal, non-exclusive and non-transferable right to use the Service, limited to the duration of their subscription.

8. Data Protection

The processing of personal data is governed by our Privacy Policy, which is an integral part of these ToS.

ACKTECK undertakes to comply with applicable regulations regarding personal data protection, including GDPR.

9. Liability

9.1 Service Availability

ACKTECK strives to ensure Service availability 24/7, but cannot guarantee absolute availability due to Internet constraints.

9.2 Limitation of Liability

ACKTECK's liability can only be engaged in case of proven fault. In any case, ACKTECK's liability is limited to the amount paid by the User over the last 12 months.

9.3 Service Use

The User remains solely responsible for their use of the Service and the consequences of that use.

10. Duration and Termination

10.1 Duration

These ToS take effect upon User registration and remain applicable as long as the User uses the Service.

10.2 Termination by User

The User can cancel their subscription at any time from their customer area. Cancellation takes effect at the end of the current subscription period.

10.3 Termination by ACKTECK

ACKTECK may terminate Service access in case of serious breach of these ToS, after unsuccessful notice period of 8 days.

11. Applicable Law and Jurisdiction

These ToS are subject to French law. In case of dispute, the parties will attempt to find an amicable solution. Failing that, French courts will have sole jurisdiction.
